NLRB Plans to Protect Workers from Employer “Omnipresent Surveillance”

On Monday, the National Labor Relations Board's (NLRB) General Counsel Jennifer Abruzzo announced her intention to protect employees, to the greatest extent possible, from intrusive or abusive electronic monitoring (described as "omnipresent surveillance") and automated management practices through vigorously enforcing current law and by urging the NLRB to apply settled labor-law principles in a new framework.

HHS OIG to audit for Potentially Preventable Hospitalizations from Care Centers

The Office of the Inspector General (OIG), a division of the US Department of Health and Human Services (HHS), announced an additional investigation as part of its 2022 work plan. Its added focus will be on whether skilled nursing facility residents were hospitalized with certain conditions and whether the facility provided services per the resident’s care plan and professional standards of practice.

CMS Releases New QSO on Nursing Home Vaccine Mandate

On Oct. 26, the Centers for Medicare and Medicaid Services (CMS) released QSO 23-02-ALL, replacing QSO 22-07-ALL and QSO 22-11-ALL. The new version revises guidance for staff vaccination requirements and includes multiple attachments for each provider type. Nursing homes should continue to refer to Attachment A.

According to a new report by Clifton Larson Allen (CLA), the total cost per patient day from 2019 to 2021 has increased by 28% or $73 per day. DOL Issues Rulemaking Notice to Change the Worker-Contractor Classification Rule

Definition of Electronic Health Information Expanded to Include Electronic Protected Health Information

Starting on Oct. 6, the definition of electronic health information (EHI) in the 21st Century Cures Act (Cures Act) expanded to include electronic Protected Health Information (ePHI) that a patient has the right to access under the Health Insurance Portability and Accountability Act (HIPAA). Healthcare providers must provide patients, residents, and clients easy access to a wider swath of EHI under the Cures Act or face potential penalties.
